Terms and Conditions for using MakeMyKankotri platform and services.

1. Agreement to Terms

By accessing or using MakeMyKankotri ("Platform," "Service," "we," "us," or "our") at www.makemykankotri.in, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, please do not use our Platform.

These Terms apply to all users, including visitors, registered users, and paying customers.

2. Description of Services

MakeMyKankotri provides a digital self-service platform for creating and sharing animated invitation cards with personalized voice greetings for:

  • Wedding ceremonies and celebrations
  • Baby showers (Godh Bharai)
  • Engagement parties
  • Birthday celebrations
  • Other personal social events

Core Features:

  • Animated invitation templates with smooth, professional animations
  • Personalized voice greeting generation via our technology partners
  • Guest management system
  • RSVP tracking and analytics
  • Multi-language support (English, Hindi, Gujarati)
  • WhatsApp and social media sharing
  • Mobile-responsive invitation pages

MakeMyKankotri is a platform-as-a-tool. We provide the infrastructure and technology; you are solely responsible for the content you create and the manner in which you use and share it.

3. User Accounts

3.1 Registration

  • You must provide accurate, current, and complete information during registration
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must be at least 18 years old to create an account
  • One person may not maintain multiple accounts for the purpose of circumventing platform policies
  • You are responsible for all activities that occur under your account

3.2 Account Security

  • Use a strong, unique password
  • Do not share your login credentials with others
  • Notify us immediately of any suspected unauthorized access to your account
  • We are not liable for losses caused by unauthorized use of your account resulting from your failure to secure your credentials

3.3 Account Termination

You may delete your account at any time through your account settings. We reserve the right to suspend or terminate accounts that:

  • Violate these Terms
  • Engage in fraudulent or illegal activities
  • Abuse or misuse the Platform or other users
  • Remain inactive for extended periods (with prior notice)

4. Pricing and Payments

4.1 Pricing Model

Simple Pay-Per-Invitation Model:

  • Each template has a fixed, all-inclusive price displayed before purchase
  • Pay once each time you create an invitation from a paid template
  • All features are included (voice greetings, animations, RSVP tracking)

Example: Creating an invitation from a template priced at ₹299 requires a one-time payment of ₹299. Creating another invitation from the same template at a later date requires a new payment.

4.2 What's Included

Every paid template purchase includes:

  • Full invitation customization
  • Voice greetings
  • RSVP tracking and analytics
  • WhatsApp and social media sharing
  • Mobile-responsive pages
  • All animations and features

4.3 Payment Processing

  • Payments are processed securely through our payment gateway partners
  • All prices displayed are final; no hidden charges apply
  • Payment confirmation will be sent via email
  • Your invitation is created immediately after successful payment

4.4 Refund Policy

  • All purchases are final and non-refundable once payment is completed and your invitation is created, as digital services are delivered immediately upon purchase
  • Exceptions may be considered only for: technical errors preventing invitation creation, duplicate charges due to a system error, or complete platform unavailability at time of purchase

5. User Content and Responsibilities

5.1 Your Content

You retain ownership of all content you create on MakeMyKankotri, including invitation text, guest information, voice message text, and uploaded media.

By using our Platform, you grant us a limited, non-exclusive, royalty-free license to:

  • Store, process, and display your content to deliver the service
  • Transmit your voice message text to our technology partners for audio generation
  • Deliver your invitations to guests via public URLs as directed by you
  • Use anonymized, aggregated data for analytics and platform improvements

5.2 Content Guidelines

You agree NOT to create or share content that:

  • Violates any applicable laws or regulations
  • Infringes on intellectual property rights of any third party
  • Contains hate speech, harassment, threats, or discrimination
  • Promotes violence, illegal activities, or self-harm
  • Contains explicit, pornographic, or inappropriate material
  • Spreads false information, spam, or phishing content
  • Impersonates any person, organization, or entity

5.3 Guest Information — User's Sole Responsibility

You acknowledge and expressly agree that:

  • MakeMyKankotri is a platform tool. The platform enables you to manage and share invitations with people you personally know, such as family, friends, and social acquaintances invited to your event
  • You are solely and exclusively responsible for all guest data you enter into the platform, including names, phone numbers, email addresses, and relationships
  • You represent and warrant that you have a legitimate personal or social basis to contact each individual whose information you add (e.g., they are a known guest of your event, a personal contact, or a family member)
  • You will ensure that your use of the platform complies with all applicable data protection, privacy, and telecommunications laws in India and any other jurisdiction applicable to you
  • You will not use this platform to send unsolicited commercial communications, bulk marketing messages, or spam to individuals who have not given you reason to be contacted
  • MakeMyKankotri is not a party to the relationship between you and your guests and bears no responsibility for your communications, the content of your invitations, or any claims made by guests or third parties arising from your use of the platform

5.4 Media Rights

You represent and warrant that:

  • You own or have obtained all necessary rights and permissions for any images or media you upload
  • Your content does not infringe on any third-party copyrights, trademarks, or personality rights
  • You have obtained necessary permissions for any photographs of identifiable individuals

6. Intellectual Property Rights

6.1 Platform Ownership

MakeMyKankotri and all its features, designs, templates, code, and trademarks are owned by us and protected by applicable copyright, trademark, and intellectual property laws. Nothing in these Terms transfers ownership of our intellectual property to you.

6.2 Brand and Trademark

  • "MakeMyKankotri" is a proprietary brand name and trademark
  • Use of our name, logo, or trademarks for any commercial purpose requires our prior written consent

6.3 Template Usage

  • Templates are licensed for your personal, non-commercial use only
  • You may not resell, redistribute, sublicense, or repackage templates
  • Templates may not be used to build competing invitation services

6.4 Attribution

  • Branding or attribution links to MakeMyKankotri in invitation footers must remain intact unless otherwise agreed in writing

7. Service Usage and Limitations

7.1 Acceptable Use

You agree to use MakeMyKankotri solely for legitimate personal event invitation purposes. Prohibited activities include:

  • Using the Platform for spam, phishing, unsolicited marketing, or fraudulent activities
  • Attempting to access areas, data, or systems you are not authorized to access
  • Reverse-engineering, decompiling, or attempting to extract the Platform's source code
  • Overloading, attacking, or interfering with Platform infrastructure or other users
  • Creating automated bots, scrapers, or scripts to access the Platform (rate limiting is enforced)
  • Reselling, sublicensing, or commercializing access to the Platform without our written consent

7.2 Service Limitations

  • Guest Management: Subject to platform capacity policies
  • Voice Generation: Subject to availability of our voice technology partners' services
  • Storage: Media and voice files stored on secure cloud infrastructure with reasonable retention limits
  • Uptime: We aim for high availability but do not guarantee uninterrupted, error-free service
  • Feature Changes: We may add, modify, or discontinue features with or without prior notice

7.3 Third-Party Services

Our Platform integrates with trusted third-party service providers for payment processing, media and file storage, voice generation, and application hosting. Use of these services is subject to their respective terms and policies, over which we have no control.

8. Voice Greetings

8.1 Technology

  • Voice greetings are generated using audio synthesis technology provided by our trusted service partners
  • Supports multiple languages including Gujarati, Hindi, and English
  • Output quality and style depend on the service partner's capabilities at the time of generation

8.2 Your Responsibility for Voice Content

  • You are solely responsible for the text content you provide for voice messages
  • Voice content must comply with our Content Guidelines in Section 5.2
  • Generated audio is produced entirely from the text you supply; we do not modify your message content

8.3 No Guarantees on Voice Output

  • Voice output quality depends on text complexity, language, and the capabilities of our service partners at the time of generation
  • We do not guarantee specific pronunciation, accent, or rendering accuracy
  • Audio playback depends on the guest's device, browser, and internet connectivity, which are outside our control

9. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains what data we collect, how we use and protect it, your rights, and our service partners. By using MakeMyKankotri, you also agree to our Privacy Policy.

10. Disclaimers and Limitations of Liability

10.1 Service "As-Is"

MakeMyKankotri is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to:

  • Merchantability or fitness for a particular purpose
  • Uninterrupted, timely, secure, or error-free service
  • Accuracy or reliability of voice generation output
  • Compatibility with all devices, browsers, or operating systems

10.2 No Liability for Third-Party Services

We are not responsible for:

  • Failures, outages, or errors caused by third-party service providers (payment, storage, voice, hosting)
  • Guests' inability to view invitations or play audio due to device or connectivity limitations
  • Social media platforms' or messaging applications' handling of shared links
  • Internet outages, network failures, or regional connectivity issues

10.3 No Liability for User Actions

We are not responsible for:

  • The content of any invitation created by a User
  • How Users communicate with or treat their guests
  • Any legal claims, disputes, or complaints arising from a User's sharing of invitations
  • Any unauthorized or improper use of guest data by a User

10.4 Limitation of Liability

To the maximum extent permitted by applicable law:

  • We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total aggregate liability to you shall not exceed the total amount you paid us in the 12 months preceding the claim
  • We are not liable for any data loss if you fail to maintain your own backups of critical information
  • We are not liable for issues caused by your own error, negligence, or misuse of the Platform

10.5 Force Majeure

We are not liable for any delay or failure to perform our obligations caused by circumstances beyond our reasonable control, including natural disasters, pandemics, government actions, wars, civil unrest, internet outages, infrastructure failures, or cyberattacks beyond our reasonable ability to prevent.

11. Indemnification

You agree to fully indemnify, defend, and hold harmless MakeMyKankotri, its owners, directors, employees, and service partners from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use or misuse of the Platform
  • Your violation of these Terms or any applicable law
  • Your content, including invitation content or guest data, that infringes or is alleged to infringe any third-party rights
  • Any communication you send to guests or third parties via the Platform
  • Unauthorized or unlawful access to your account resulting from your negligence

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

12.2 Informal Resolution

Before initiating any formal proceedings, please contact us at contact@makemykankotri.in to attempt good-faith resolution of any dispute.

12.3 Arbitration

Any disputes that cannot be resolved informally within 30 days shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 (India), conducted in Surat, Gujarat, India. The language of arbitration shall be English.

12.4 Class Action Waiver

You agree to resolve any disputes with us on an individual basis only. You waive any right to participate in any class action, collective action, or representative proceeding.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes take effect upon posting the updated Terms on this page with an updated "Last Updated" date. Your continued use of MakeMyKankotri after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must discontinue use.

14. Termination

We may suspend or terminate your access to the Platform immediately, without prior notice, for:

  • Violation of these Terms
  • Fraudulent, illegal, or abusive activities
  • Conduct that harms other users, guests, or third parties
  • Non-payment for services rendered
  • Security concerns or threats to platform integrity

Upon termination:

  • Your access to the Platform will be revoked immediately
  • Active invitation links may remain accessible to guests for a limited grace period at our discretion
  • We may delete your account data 30 days after termination
  • You remain liable for any outstanding payments or obligations incurred prior to termination

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy and Cancellation & Refund Policy, constitute the entire agreement between you and MakeMyKankotri with respect to the Platform and supersede all prior agreements or understandings.

15.2 Severability

If any provision of these Terms is found invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

15.3 No Waiver

Our failure to enforce any right or provision of these Terms on any occasion does not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign our rights to any successor entity or affiliate.

16. Acknowledgment

By using MakeMyKankotri, you acknowledge that:

  • You have read, understood, and agree to be bound by these Terms & Conditions
  • You are of legal age (18 years or older) to enter into this agreement
  • You will use the Platform responsibly, lawfully, and in accordance with all applicable laws
  • You accept sole responsibility for the content you create and the manner in which you use and share it
